Federal Second Circuit CourtThe Federal Second Circuit Court or sometimes referred to as the Second Circuit is a appeals court within the United States. It is one of the thirteen Courts of Appeals within the U.S. It is located in at the Thurgood Marshall U.S. Courthouse in New York City.

There are 13 active judges that occupy the bench within the second circuit court.

Federal Second Circuit Court Jurisdiction

The second Circuit appellate court covers over 94 United State District Courts.

This appeals court was founded on June 16, 1891. It has jurisdictions over Vermont, Connecticut, and New York State. These are the trial courts for each of the circuits:

  • Eastern District of New York
  • Northern District of New York
  • Southern District of New York
  • District of Vermont
  • District of Connecticut

Clerk’s Office and Responsibility

The Clerk of Court has been put in charge with maintaining accurate records for all of the fillings and judicial proceedings within the Court of Appeals. Working with the Administrative Office of the U.S. the Clerk will perform duties as they are directed by the Court.

Among the above responsibilities, the Clerk will process all appeals that have been filed to the Second Circuit Court of Appeals to make sure they are in compliance with FRAP and other local rules from the Courts.

The Clerk handles all the decisions from the opening to the end of the case. The Clerk will also be responsible for caseload statistics along with bills of costs.

Notable Cases From the Federal Second Circuit Court

Nichols v. Universal Pictures Corp.

Nichols v. Universal Pictures Corp. was a court hearing held in 1930 on a case of copyright infringement by non-literal copying of dramatic work. The Second Court held that the copyright protection cannot extend to characteristics of stock characters in a story. Whether that story by a film, book or play.

The court was opposed the question as to whether the defendant’s picture or film did infringe on the plaintiff’s copyright in the play because of the use of similar elements.

Deflate-Gate – New England Patriots

If you were a football fan and even if you weren’t you probably heard about the deflate-gate. This was when Tom Brady was accused of purposely deflating the football. Footballs need to be at a certain PSI pressure and Toms football was below this level. The lower pressure would allow for a better grip on the football in return making it easier to catch and hold on to.

The National Football League brought down a 4 game suspension for Tom after the investigation. Even though a judge reversed the suspension the Second Circuit Court reversed the decision, upholding the 4 game suspension.
