What is a misdemeanor?

Generally speaking, a misdemeanor is not as serious as a felony.  with that said misdemeanors are non-indictable offenses.  These types of offenses are fines that could be up to $5,000 and carry a sentence up to 10 years imprisonment.  Below are what is classified as a misdemeanor in Alabama:

  • Reckless driving
  • DUI (Driving under the Influence)
  • Petty theft
  • Assault in the second degree

What are inmate and jail records?

Alabama juvenile criminal records

Typically juvenile records are not searchable by the public and are sealed from view.  Unless you have special permission you will not be able to search these records, let alone view them.

Can a conviction be expunged from the record? No, only charges can for non-felonies or for someone with a non-violent felony under certain circumstances get expunged.

If your record was expunged then it cannot be sued for any non-criminal justice purpose. However, it will still be viewable to criminal justice agencies on the acknowledgment of another criminal matter of that person in relation to the expungement.

Will an expunged criminal charge show when an employee does a background check? No, once the expungement happens they are no longer part of public records and will not show.
